1.3 This page tells you the terms and conditions on which we supply our products. Please review the Terms carefully. The Terms apply to all users of our website, including without limitation, users who are browsers, customers, merchants, vendors and/or contributors of content. If you access and use this website, you accept and agree to be bound by and comply with the Terms and our Privacy Policy. If you do not agree to the Terms or our Privacy Policy, you are not authorised to access our website, use any of our website’s services or place an order on our website.
2. How the contract is formed
2.1 The terms “we”, “us”, and “our” refer to British Candy Box.
2.2 When you place an order with us, you are making an offer to buy goods. We will send you an email to confirm that we have received your order.
2.4 In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. Your order will not be placed and there will be no contract between us pending further instruction.
2.5 Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown on the website and will not include any of the pictured accessories, unless stated in the specification of the goods.
2.6 We have made every effort to display as accurately as possible the details of our products that appear on this website.
2.7 Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.
2.8 This contract is covered by English law.
2.9 By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.
3. How to place an order
3.1 You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time.
3.2 The buyer accepts full responsibility for checking the accuracy of the order made.
3.3 The buyer assumes responsibility for the goods being suitable for the purpose for which they are being purchased.
3.4 Carriage charges will be shown prior to you placing your order.
3.5 When you subscribe your payment will be taken immediately, thereafter your payment will be processed on the last day of every month. All candy boxes will be dispatched the first week of each month. You can cancel anytime, without hassle.
Please note: you will not be charged until the last day of the month for each subsequent order.
3.6 We use secure payment facilities for online purchases. You can pay for your order by Visa, Mastercard or Delta/Connect.
3.7 Promotional prices, if applicable, only apply during the period stated.
3.8 All prices quoted on our website include Value Added Tax at the current rate. All payments shall be made in United Kingdom pounds sterling. Please note we cannot be held responsible for adverse currency fluctuations. The conversion rate is set at the point of authorisation of your credit/debit card.
3.9 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an order confirmation
3.10 If we have made a pricing error, we will either contact you for instructions before dispatching the product or reject your order and notify you of such rejection.
3.11 Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.
3.12 Once your order is complete we will notify you of the dispatch date.
4. Delivery & Carriage Charges
4.1 We aim to dispatch all candy boxes within the first week of each month and it should be with you within 2 to 10 working days of dispatch (Most European destinations 2 to 5 working days, non-European countries 4 to 10 working days approximately). UK weekends and Bank holidays are not classed as working days. Because we use a third-party delivery service, these times are estimates and not guarantees. However, please let us know if you do not receive your order in good time and we will look into the matter. Delivery times may be longer for certain products.
4.2 If you order products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount.
4.3 Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

5. Cancellation and returns
5.1 You can cancel your contract between us within the 14-day cooling off period (see clause 5.4 below). We will process your refund due to you as soon as possible but in any event within 21 days from the date we receive notice of cancellation. We will refund the price of the product plus the cost of sending the item to you.
5.2 If you cancel, you must return the goods within 14 days of cancellation, complete with the original packaging to us at your own expense. You must ensure that the goods are packaged adequately to protect against damage.
5.3 You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.
5.4 Except where a product is defective, this policy does not apply to goods ordered by businesses or to the value of £42 GBP or less which are exempt from the Distance Selling Regulations, or to the following goods which are exempt from the right to cancel.
Products produced or altered to your own specification, perishable goods, including fresh foods or plants; DVDs or CDs where you have broken the seal or magazines.
5.5 Products may contain nuts, dairy and other allergens. If you feel this may affect the recipient, please do not subscribe.
5.6 We are not liable for any loss due to late, damaged, incorrect or lost deliveries.
5.7 This cancellation policy does not affect your legal rights - for example, if goods are faulty or misdescribed.
6. Faulty Goods / Guarantee
6.1 If there is a problem with the goods, you must notify us within 2 days of receipt of the goods by email providing details of the problem. In addition, you must provide us with a digital photograph of the problem as this may save you having to return the goods for inspection. We will deal with the matter in accordance with your legal rights.
6.2 If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until either a indicative digital image is supplied by you, or the original goods have been received by us and checked. The cost of returning goods to us is your responsibility, however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we may return them to you, in which case you will be required to cover our reasonable postage costs.
6.3 During the Summer months some products, especially confectionary, may melt during transportation. All orders containing such products are shipped at the customer's’ own risk. Once dispatched, we are unable to control the temperature that the goods are shipped at and therefore we are unable to take responsibility for items that, once delivered, turn out to have suffered any type of heat damage.
6.4 If an item is no longer available we will offer an alternative. However, our liability will be to replace the faulty goods only and we are unable to guarantee an exact match. In this instance, you will have the option of a refund on the items.
6.15 Where we replace faulty goods you are responsible for their disposal if they have not previously been returned to us.
7. Liability
7.1 The products sold on this website have been designed to comply with all relevant UK legislation. We cannot warrant or represent that they comply with any legal requirement outside the UK.
7.2 All descriptions, product images and weights are those of the original manufacture and are intended to give a general description of the goods. The weight to be shipped includes the weight of packaging for the goods.
7.3 We warrant to you that any Product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.
7.4 Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product you purchased
8. Risk & Title
8.1 The Products will be at your risk from the time of delivery.
8.2 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

3. Site Uptime
3.1 We take all reasonable steps to ensure that this Website is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and, other technical issues. Therefore we will not be liable if this website is unavailable at any time.
